Evidence of insurance, license, training, references, etc. can be reviewed by other users who may be interested in entering into a business relationship with such users, and (2) allowing users to make their own independent evaluations of whether they are interested in entering into such business relationships with other users. WorkMyPrice.com allows users who enter into a business relationship with each other to rate one another.
These are the terms in which WorkMyPrice.com offers you access to our services. This agreement describes the terms and conditions applicable to your use of our services available under the WorkMyPrice.com domain. By registering with WorkMyPrice.com you accept the terms and conditions of this Agreement, you hereby agree and acknowledge that at anytime and in our sole discretion, we may effectively modify the terms and conditions of this Agreement by posting the modified Agreement with its new terms and conditions on the WorkMyPrice.com website. All modified terms and conditions shall take effect immediately after posting to the WorkMyPrice.com website. You agree and consent to any and all modified terms and conditions hereunder. This Agreement may not be modified,amended, and/or changed by you in any manner. Furthermore, you agree that we may modify this Agreement or discontinue our website at anytime and without notice and without any liability or responsibility to you. This agreement is effective on December 3, 2011 for all users.
WorkMyPrice.com is a neutral venue. We do not endorse any users, neither do we assist or participate in any transactions between users. Users are responsible for all communications and business transactions between each other. Therefore, we have no control over quality,safety or legality of transactions conducted our website.
However,key measures are in place to minimize risks associated with safety, quality and misconduct. These key measures include identity and address verification, ratings & reviews, links to resources for background checks, safety tips, etc.
WorkMyPrice.com helps connect service providers and consumers in various work industries by (1)allowing consumers to create accounts and post information regarding needed services. (2) Allowing service providers to post their services and contact consumers to render services. Ratings & reviews, business filings,certifications, proof of insurance coverage, copies of trade or business licenses and other information can be reviewed by consumers who may be interested in entering into a business relationship with service providers provided the service providers choose to disclose this information.
You understand and acknowledge that WorkMyPrice.com does not and cannot control the reliability, completeness, usefulness, safety or accuracy of data and information available through the site, because such data and information is provided solely by the users, who are third parties independent of WorkMyPrice.com.You also acknowledge and agree that any and all communications, correspondence(verbal or written), or any warranties or representations made are not provided by WorkMyPrice.com and are specifically and solely between you and the other user. Because we are not involved in the actual transaction between users, we have no control over the accuracy of listings, the ability of a user to pay for services, or the ability of the service provider to complete services.
USE OF SERVICES
Users must be at least 18 years old to register. If you are under 18, a parent or legal guardian must register on your behalf; and they will be liable for your actions on the site.
You agree that you will use WorkMyPrice.com for the sole purpose it is intended for and not for advertising information irrelevant to service listed in our categories. (If interested in advertising on our site, contact us for advertising opportunities.) You are not to use WorkMyPrice.com services to solicit or harass any users for any other purposes not considered within this document. You agree that all content and information posted on WorkMyPrice.com is the sole and exclusive property of WorkMyPrice.com and you have no right to use any of the information for purposes unrelated to your posting(s). You concur that violation of the above mentioned may result in significant damages and you agree to indemnify WorkMyPrice.com should any third party claims against WorkMyPrice.com occur as a result of your violation. We retain the right to suspend or revoke your account at anytime without obligation and/or advance notification. If it is determined or suspected by WorkMyPrice.com that you have violated, abused, misused or attempted to misuse WorkMyPrice.com services and/or system, we reserve the right to suspend your account indefinitely and without notice, take legal actions to seek remedies and/or damages.
TO KNOWINGLY INPUT FALSE INFORMATION, INCLUDING BUT NOT LIMITED TO NAME, PHONE NUMBER, ADDRESS OR E-MAIL ADDRESS IS A VERY SERIOUS AND FRAUDULENT MATTER THAT COULD RESULT IN SIGNIFICANT COSTS AND DAMAGES INCLUDING INVASION OF PRIVACY RIGHTS, TO WORKMYPRICE.COM AND ITS SERVICE PROVIDER PARTNERS, AND TO CONSUMERS, AS WELL AS THE LOSS OF TIME, EFFORT AND EXPENSE RESPONDING TO AND PURSUING SUCH FALSE INFORMATION AND REQUEST, AND FURTHER, COULD RESULT IN REGULATORY FINES AND PENALTIES. ACCORDINGLY, IF YOU KNOWINGLY INPUT FALSE INFORMATION IN A WORK POSTING, INCLUDING BUT NOT LIMITED TO SOME ONE ELSE'S NAME, E-MAIL ADDRESS, PHYSICAL ADDRESS OR PHONE NUMBER OR A RANDOM OR MADE UP NAME, ADDRESS, E-MAIL OR PHONE NUMBER YOU AGREE TO FULLY INDEMNIFY AND BE LIABLE TO WORKMYPRICE.COM AND EACH WORKMYPRICE.COM SERVICE PROVIDER WHO ACCEPTS SUCH WORK REQUEST, FOR THE GREATER OF: (1) A MINIMUM AMOUNT OF $11,000 TO EACH OF WORKMYPRICE.COM AND EACH OF THE AFFECTED SERVICE PROVIDER AND FOR EACH OF THE ACTUAL PERSON(S) AFFECTED BY ANY OF THE IMPROPER, INCORRECT OR FRAUDULENT INFORMATION YOU ENTER (FOR EXAMPLE THE ACTUAL OWNER OF THE E-MAIL ADDRESS OR PHONE NUMBER, ETC.), PER IMPROPER SUBMISSION, PLUS ANY ATTORNEYS FEES COSTS AND EXPENSE RELATING THERETO, IF APPLICABLE, OR (2) THE ACTUAL DAMAGES, DIRECT,PUNITIVE AND CONSEQUENTIAL, AND ANY REGULATORY OR JUDICIAL FINES OR PENALTIES THAT MAY ARISE FROM SUCH INTENTIONAL, MISLEADING, HARMFUL AND FRAUDULENT ACTIVITY, PLUS REASONABLE LEGAL FEES, COST AND EXPENSES RELATING THERETO, WHICHEVER IS GREATER.
CODE OF CONDUCT
You shall abide by the following standards of conduct. Your failure to fully abide by the following standards of conduct may result in the immediate termination or suspension of your account or your access to workmyprice.com. You agree that you shall not:
(1) send spam or otherwise duplicative or unsolicited messages in violation of applicable laws;
(2) upload, email, post, publish or otherwise transmit through the site any content that is harassing or invades another's privacy, or promotes bigotry, racism, hatred or harm against any group or individual
(3) solicit other users of the Site to use or join or become members of any commercial online or offline service or other organization;
(4) send or store data, information or material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs;
(5)interfere with or disrupt the integrity or performance of the Site, or the data, information or materials contained thereon;
(6) attempt to gain unauthorized access to the Site;
(7) restrict or inhibit any other visitor or user from using the site, including, without limitation, by means of "hacking"or defacing any portion of the site;
(8) use the site for any unlawful purpose;

(11) harvest or collect information about Site users without their express consent;

ANY ATTEMPTED IMPROPER USE OR AN ATTEMPT BY YOU OR ON YOUR BEHALF TO DELIBERATELY DAMAGE OR CORRUPT THE SITE OR TO USE WORKMYPRICE.COM IS VIOLATION OF THE ABOVE STANDARDS OF CONDUCT MAY VIOLATE CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, WORKMYPRICE.COM AND ITS RESPECTIVE AGENTS RESERVE THE RIGHT TO CANCEL YOUR ACCOUNT, PROSECUTE AND SEEK DAMAGES FROM YOU TO THE FULLEST EXTENT OF THE LAW.
You understand and acknowledge that you may be exposed to data and information that is inaccurate or that otherwise violates any of the standards of conduct described above, and you hereby waive all legal or equitable rights or remedies you may have against WorkMyPrice.com.com with respect thereto.
You understand and acknowledge that the services of WorkMyPrice.com is provided to you solely as means for helping you connect with businesses and/or individuals in need of services or that provide services. Without limiting the generality of anything set forth in these Terms of Service, you also acknowledge and agree that WorkMyPrice.com has no monitoring, enforcement or other obligations or responsibilities in relation to the users, any data,information or materials provided by them, their businesses or any business relationships between them. If you decide to enter into a business relationship with a user, you understand and agree that you do so at your sole risk and you are solely responsible for managing such business relationship and enforcing any and all rights and remedies you may have against such user.
Flagging System
WorkMyPrice.com is self-policed by users via a flagging system. The flagging system is used to report users who are in violation of the code of conduct. Suspected violators should be flagged by visiting their posting and clicking on the "Flag this posting" or "Flag this profile". Our contact form may also be used to contact us regarding violators.
Service Providers Conduct
Service providers that enter into a business relationship with a consumer shall be solely and fully responsible for abiding by all applicable industry and professional standards, including, without limitation:(1) perform services as agreed upon within the specified time frame at the agreed upon price; (2)provide appropriate parties with an invoice and/or receipt upon completion of services; (3) interact with all parties in a professional and courteous way; (4) maintain adequate insurance coverage and applicable licenses or bonds at all times (if applicable); and (5) comply with all applicable laws, rules and regulations. WorkMyPrice.com has no monitoring,enforcement or other obligations or responsibilities in relation to compliance with such industry and professional standards. You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations of your service industry.
Consumers Conduct
Consumers shall only post work he/she intends on having completed. You shall not post phony, bogus, unofficial or unlawful work postings for any reason. All major details involved with work posts that may influence the price must be included under the “Work Detail” section of the order form to avoid misunderstandings and problematic issues.
Consumers that enter into a business relationship with a service provider shall be responsible for (1) making sure service provider shave all information needed regarding your posted work before agreeing to your posted price, (2) conducting background check or exercise due diligence before entering into an agreement with service providers, (3) paying service providers on terms agreed upon. Failure to comply may increase consumer risk and liability.
CONSENT TO BE CONTACTED.
By registering with WorkMyPrice.com, you consent to be contacted by us and registered service providers. Some of the information you disclose about yourself upon registering and posting on our site will be used to contact you or respond to your posting. You agree that all the information you provide is accurate to the best of your knowledge. If you knowingly provide false information or we believe such information is inaccurate, WorkMyPrice.com has the right to suspend and/or deny any future use of our service or any portion thereof by you. You are responsible for or any persons whom you allow to use your WorkMyPrice.com account whether you intentionally or negligently allow access to your login information. WorkMyPrice.com has no reason to and will never ask for your password.
RESOLUTION PROCESS AND LIMITED SERVICE GUARANTEE.
We at WorkMyPrice.com do not guarantee any work performed by any service provider. Nor are we obligated to you regarding any transactions or feedback between you and other users. In rare instances, disputes occur that need resolving. WorkMyPrice.com has developed a dispute resolution process in an attempt to assist you and the other party in the event of a dispute. While we have no obligation, we may provide limited assistance in resolving disputes between you and another user upon request. Should you and the other party agree to participate in the dispute resolution process, you must make a faithful effort to resolve the issue by following the steps of the process. If we deem you have not participated in the resolution process faithfully, we may terminate the process and recommend that you seek other legal means of resolving the dispute.

Service Providers Profiles
WorkMyPrice.com provides a platform for service providers to post profiles relevant to their business and/or skills on our website. Service providers are available to you “as is”. It is impossible for WorkMyPrice.com to review and/or monitor all profiles for accuracy,violations and misrepresentations. Therefore, inaccuracies, violations and misrepresentations should be reported by users by clicking on the “Report this Service Provider” link on the service provider’s profile page. Although service providers may provide various business documents, we make no representation or guarantee that service providers are insured, licensed, bonded and/or compliant with all regulations relevant to the specific service industry. Nor does WorkMyPrice.com guarantee the accuracy of any information provided by service providers or consumers on the website. We recommend consumers exercise due diligence when considering a service provider and before having work done.
FEEDBACK (RATINGS& REVIEWS)
Ratings & Reviews are not endorsed by WorkMyPrice.com.com. Providing feedback is possible between two users once work has been assigned. You agree that you will not use feedback from WorkMyPrice.com in any other venue. Service providers are rated in five areas that determine quality service via five star rating system (Average based). Reviews may be left in support of ratings as an opportunity to explain your experience in dealing with the other user. Users should use caution and good judgment when leaving feedback for other users because, users could be held liable for damages to a user’s reputation if a court were rule there marks constitute defamation.
Although the administrators of WorkMyPrice.com attempt to keep all objectionable listings off the site, it is impossible for us to review all posted information. All feedback express the views of the author, and WorkMyPrice.com does not assume responsibility or liability for any Review or for any claims, damages, or losses resulting from any use of the Site or the materials contained therein, according to federal law (Communications Decency Act). This law does not protect the author.
By using WorkMyPrice.com, you warrant that you will not post any messages that are obscene, vulgar, sexually-oriented,hateful, threatening, or otherwise in violation of any laws. The administrators of WorkMyPrice.com reserve the right to delete and edit postings as well as cancel user accounts anytime.
Ratings for service providers with multiple profiles are averaged among all profiles. Manipulating Feedback Is not permitted in any form or fashion. If we have reason to suspect a user has manipulated the system, it can lead to account suspension.
BILLING
From time to time WorkMyprice.com may offer special promotional pricing plans which may expire when the subscription ends.
By purchasing a subscription or service with WorkMyPrice.com you agree to make payments through automatic recurring debits.I hereby authorize charges currently being deducted in accordance with my subscription billing cycle. WorkMyPrice.com subscription or services will renew automatically until a cancellation request is received. WorkMyPrice.com reserves the right to change the amount of fees and charges payable hereunder at anytime after the initial subscription ends, and upon electronic notification 30days prior. Please read this Agreement carefully and have it available for reference before calling WorkMyPrice.com regarding your automatic recurring payment. Please verify that all information provided to WorkMyPrice.com is complete and accurate before making a subscription purchase.
Frequency of Payments
An automatic recurring payment (ARP) of your selected subscription rate plan amount,or as described to you by WorkMyPrice.com website will be made every month(month to month), every 3 months (quarter to quarter), or based on your subscription selection billing cycle. Your subscription will automatically renew on an annual recurring basis. You will receive an email notification of your annual renewal date. You will also receive a post-payment confirmation email following all automatic recurring payments. For example, if you have purchased a subscription on March 1st of a rate plan requiring a $25 per month payment, and you used a coupon discount of $4.99 for a 1 month trial period, the first recurring monthly payment would only be $4.99 and debited on March 1.Your next automatic recurring payment in the amount of $25 would occur on April1st. You will not receive any advance notice of this payment but you will receive post-payment confirmation by email. Your Billing Cycle Date is based on your initial date of your subscription purchase. If your payment was made on the 31st and the next month only had 30 days your payment would be made on the last day of that month, and will then be resumed to your normal Billing Cycle Date.
Automatic Recurring Payment Failure
If your ARP is declined, you will be contacted by phone or email. We may permanently restrict your ability to use a certain payment method if that payment method fails multiple times. REMEMBER: If your payment fails, you will need to replenish your account with another payment method. In the event your payment is not made by the end of your billing cycle, your service may be suspended or cancelled.
Cancellation of Automatic Recurring Payments (ARP) and Subscriptions
You have the right to withdraw your consent to this ARP your subscription at anytime. To cancel your and subscription, visit WorkMyPrice.com, navigate to the contact us page, select Cancel Subscription. You must provide your last Invoice#, Customer ID, last Transaction #, and the last 5 digits of your debit used at subscription purchase. This information can be found in your last payment confirmation email. Your request to cancel your may take up to 24 hours to take effect. Upon receiving required cancellation information you will not be billed for any further transactions and your account access will revert to a non subscribed user.
Re-Establishing Automatic Recurring Payment and Subscription
If you wish to re-establish your and Subscription, as a Service Provider you must re-run your Profile and choose a new subscription and complete the payment process. This will automatically create a new and Billing Cycle based on the date of your purchase.
Changing Automatic Recurring Payment
If you would like to change your including, for example, making a change from one credit or debit card that was initially selected to another credit or debit card or bank account, you must authorize the recurring payment with the new credit or debit card or bank account by notifying Customer Care through the Contact Us Link under Billing Services or calling Customer Care. Once new information is updated your previously approved will be terminated within 24hours.
Access to Agreement
To access this Agreement in the future through the WorkMyPrice.com website, go to your Manage Work website page and click on "Terms of Use". If you are viewing this Agreement on the WorkMyPrice.com website, please print a copy of this Agreement for future reference. To confirm which credit, or debit card or bank account you authorized, call Customer Care we only will provide you with the last 5 digits of the card we have on file, per regulations that is theonly account information that we retain for our records.
Electronic Authorization
This Automatic Subscription Renewal Agreement is not transferable and is executed only by the person authorized on the WorkMyPrice.com account, by purchasing a subscription through the payment authorization process.
AGREEING TO THESE CONDITIONS
By providing my credit, or debit card or bank account information ("Payment Method"), I AGREE that I have read and understand this Automatic Subscription Renewal Agreement. In addition, I authorize WorkMyPrice.com to charge the full amount required by my rate plan(once every month, 3 months, or as frequently as purchased subscription’s rate plan describes) to the specified Payment Method; and I authorize the financial institution for the Payment Method, specified above to charge or debit myaccount and remit payment for my service to WorkMyPrice.com. This authority will remain in effect until I give notification, as required under this Agreement,to cancel this authorization.
INDEMNIFICATION.
You agree to indemnify and hold WorkMyPrice.com, (including our agents, employees, officers, directors, licensors, subsidiaries, parent and/or affiliated companies), harmless from any liability, loss, damage, claim or demand, including attorneys' fees and costs related to or arising out of your use of the WorkMyPrice.com Service, any transactions or interactions with third parties, your violation of this agreement, your content, or your violation of any rights of another, except to the extent your liability may be limited by applicable state or federal law(“Claims”). This indemnity shall be in addition to and not limited by any other indemnity or remedy.
GENERAL PROVISIONS.

WORKMYPRICE.COM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT MATERIALS OR PRODUCTS INCLUDED ON THIS SITE. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WORKMYPRICE.COM EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, WORKMANLIKE QUALITY OR FITNESS FOR A PARTICULAR PURPOSE,AND YOU AGREE THAT IN NO EVENT SHALL WORKMYPRICE.COM BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO,DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.
APPLICABLE LAW
This Site is created and controlled by WorkMyPrice.com in the State of North Carolina. The laws of the State of North Carolina shall govern all these policies, disclaimers, terms and conditions without giving effect to its conflicts of law principles or the conflict of law principles of any other jurisdiction. Any action or proceeding arising from the use of this Site or any product or services provided by WorkMyPrice.com shall be commenced and prosecuted only in a court in Wake County in North Carolina.By entering and/or using this Site you expressly waive any jurisdiction or venue defenses and submit to the personal jurisdiction of said courts.WorkMyPrice.com expressly reserves the right, without notice, at any time, to amend, correct or make changes to this Site, its Contents and to any disclaimers or these terms and conditions.
